This document presents principles on which we process personal data provided or collected by Bogutti Sp. z o.o. with its registered office in Henryków-Urocze.

The purpose and the legal basis for processing personal data  Personal data are collected as follows: Delivering products and providing services by the Controller, as well as taking necessary actions before concluding contracts (legal basis Article 6(1)(b) of the GDPR ) – For instance: a situation where you contact the controller to obtain a product offer.When you provide services for the Controller, the purpose of data processing by the Controller will be performing the contract to which you are a party or taking steps on the request of the data subject prior to entering into the contract (legal basis Article 6(1)(b) of the GDPR) For instance: when you deliver raw materials for the production of confections to Bogutti sp. z o.o. or provide different services for the benefit of Bogutti sp. z o.o.to fulfil the legal obligations of the Controller, such as issuing and storing invoices (legal basis Article 6(1)(c) of the GDPR) For instance: When you provide services to Bogutti sp. z o.o. – personal data such as your first name, last name and tax identification number are necessary for us to issue correct invoices and to store them. in order to establish, assert or defend claims in connection with the services provided by the Controller (legal basis: Article 6(1)(f) of the GDPR) For instance: when you lodge a product complaint with Bogutti sp. z o.o., we will need your contact details to be able to consider the complaint. for marketing purposes – your personal data will be processed on the basis of Article 6(1)(f) of the GDPR. The Controller relies on the legitimate interest of collecting statistical information and analysing website traffic. in order to establish contact and answer enquires; the legal basis for processing personal data is the necessity of processing for purposes arising from legitimate interests pursued by Bogutti Sp. z o.o., in accordance with Article 6(1)(f) of the GDPR to ensure proper service to the Website user by answering their enquiry.
Are you required to provide your personal data? Personal data are provided to us voluntarily. However, in some circumstances, it is necessary to indicate personal data to enable us to provide services for your benefit, or when services are provided to the Controller, or claims are asserted under law.   In the event of a separate and voluntary consent, the purpose of processing your personal data may also include transferring and sending marketing information and offers about the Controller’s products and services by e-mail and/or telephone (pursuant to Article 10 Act on the Provision of Electronic Services and Article 172 of the Telecommunication Law). For instance: when you give consent for sending marketing content to your e-mail address, we will send promotional materials if we decide to launch promotional campaigns.   Your consent may be withdrawn at any time. The withdrawal of the consent will not affect the validity of the processing conducted before the withdrawal.

Data recipients Your personal data may be disclosed to our partners, i.e. companies with which we cooperate. Our subcontractors (processors), such as accounting and IT companies, claim adjusters, and contractors of claims handling services, may also have access to your data.  
Automated decision-making  Data may be also subject to profiling to the extent covered by your consent. Profiling will include proposing products/services that are best suited to your needs.   The Controller does not make decisions in an automated manner.   In special situations, your personal data may be transmitted to third countries (i.e. countries outside the European Economic Area) which, according to a decision of the European Commission, ensure an adequate level of data protection as well as countries which do not ensure an adequate level of your data protection due to the absence of a decision of the European Commission determining an adequate level of data protection.
Period of personal data processing Your personal data provided upon the conclusion of the contract will be processed for the term of the contract, and then for a period during which claims relating to the provision of services might be disclosed. If you give your consent, personal data will be processed for the period of your consent until its withdrawal.
